We, PT GARUDA INDONESIA (PERSERO) ("GARUDA"), a state-owned enterprise duly established under the Laws of the Republic of Indonesia by virtue of Government Regulation Number 102 of 1961 regarding The Establishment of Air Transportation State Company "Garuda Indonesian Airways", having its business field as the National Flag Carrier of the Republic of Indonesia, domiciled in Indonesia, would hereby like to present our confirmation, protest and objection and beg attention of the public to the following matters:

1. GARUDA is owns a Full Flight Simulator Mc Donnell Douglas MD 11 as our asset ("MD 11 Simulator Asset");
   
2. GARUDA discovered unauthorized photos of the MD 11 Simulator Asset, which were published in www.hollandcanadaline.com, website address owned by Holland Canada Line ("HCL") which may reasonably be considered to be part of an attempt by HCL and/or some other party(ies) through HCL to sell the MD 11 Simulator Asset to the public at large or other concerned party(ies), directly or indirectly, on behalf of GARUDA;


3. GARUDA hereby declares its OBJECTION to the publishing of the MD 11 Simulator Asset's photos by HCL and DENIES any plans for its sale by HCL and/or other party(ies) through HCL and furthermore we would like to CLARIFY that according to documents of asset ownership, the MD 11 Simulator Asset is currently the property of GARUDA and GARUDA has never asked and/or appointed any other party(ies) whomsoever, including HCL/other party(ies) through HCL, whether directly or indirectly, to market and/or sell the MD 11 Simulator Asset;


4. With regard to the publishing of the photos and information on the sale of the MD 11 Simulator Asset, we hereby make our OBJECTION and confirm that the photos and information as published in HCL's website are MISLEADING information and the publishing of such photos was done without the permission of GARUDA and must therefore be considered as an unlawful act;


5. We therefore inform to the public at large or any other concerned party(ies) intending to be involved in the sale and purchase or any other transactions on the MD 11 Simulator Asset, not to respond to any advertisements, promotions, marketing or any misleading and unlawful information published on HCL's website.


6. We hereby also urge the public at large or any other concerned party(ies) not to conduct the purchase or any other transactions on the MD 11 Simulator Asset without permission from GARUDA in order to avoid any claims and/or lawsuits, whether criminal or civil, or any other possible legal remedies from GARUDA.

Therefore we convey our WARNING and OBJECTION to the public at large and any other concerned party(ies) whomsoever for their attention.
